Account Terms and Conditions

TriParish.net is your Premium Internet Service Provider for business and personal use. Contact us at (985) 879-3219 or e-mail us at info@TriParish.net.

Terms of Internet Access Agreement Customer agrees to use the service in a manner consistent with any and all applicable local, state, and national, and/or international laws. Use of TriParish.net Network for bulk and/or unsolicited e-mail, commercial or otherwise, is prohibited and shall be cause for immediate account termination. Bulk e-mail is defined as the same or similar e-mail message sent to more than 25 recipients.

All TriParish.net Network subscribers agree to use only the e-mail address as confirmed at time of sign-up for their “Return” and/or “Reply-To” Internet e-mail address. The use of a “fake” e-mail address, e-mail address belonging to another Internet user, or no e-mail address as a “Return” and/or “Reply-To” Internet mail address is prohibited and such use shall be cause for immediate account termination.

Customer agrees to utilize appropriate protocols for data transmissions. E-mail messages are limited to a maximum of 10 MB (10000K) incoming storage space.

Customer shall be held liable for any and all costs incurred by TriParish.net as a result of customer violation of these terms and conditions: including but not limited to attorney fees and costs resulting from Postmaster responses to complaints from and cleanup of unsolicited commercial mailings and/or unauthorized bulk mailings and/or news server violations. TriParish.net’s current hourly rate for Postmaster responses to complaints and cleanup of unsolicited commercial mailings and/or unauthorized bulk mailings and/or news server violations is US $100 per hour, with a minimum one (1) hour charge.

Use of TriParish.net Network NNTP news server for spamming is prohibited and shall be cause for immediate account termination. Use of TriParish.net NNTP news server for software distribution, cross-posting messages to more than 10 news groups, the posting of off-topic messages to newsgroups, and/or as an advertising medium is prohibited and shall be cause for immediate termination.

The use of programs such as packet sniffers, host and/or service monitoring, and other similar programs is forbidden. TriParish.net may monitor all network services around the clock.

For purpose of network use, TriParish.net hereby distinguishes Business Accounts to be any account held by a Sole Proprietor, Partnership, Corporation, or any other entity engaged in an ongoing “Business Enterprise” and Personal Accounts as an account held by an individual for personal use, research, and recreation. All account activations require the disclosure of intended use, be it business, home business, or personal, and any account contract, the resale, transfer, or trade of any TriParish.net Account and/or Services strictly prohibited. Inquires regarding “Accounts for Resale” should be directed to the TriParish.net Sales Manager.

Personal Use Accounts receiving storage space for a Personal Web Page are subject to certain use restrictions for said personal page. A Personal page may be used for personal Internet distribution of subscriber’s personal information such as: bio, resume, privately owned items for sale, hyperlinks to favorite Web locations, and information to let the world know who you are and what you think. A Personal Page, other than for personal recommendations, may not be used for any business related activities such as: advertising, sales, marketing, promotions, posting information for other individuals or businesses, software FTP site, any illegal activity, and any other activities prohibited by the TriParish.net Network’s terms and conditions.

Customer is responsible for use of account(s) and confidentiality of password(s).

Billing Customer is solely responsible for any and all local or long-distance telephone charges for connecting directly to TriParish.net network or indirectly via any access broker or access intermediary. It is the sole responsibility of the customer to determine if the provided TriParish.net Network access telephone number(s) will be a local telephone call.

Customer agrees to pay TriParish.net all charges relating to use of Customer’s Account(s). Customer acknowledges that there is a 30 day minimum subscription period, which means no full or partial refund of the initial month’s service fee and activation fee will be given if service is canceled within the initial 30 day subscription period. Additionally, all cancellations become effective at the end of the current billing period for monthly subscribers or the end of the current billing month for quarterly subscribers. There are no refunds issued for a partial period of service. All requests to cancel service must be in writing via mail, email or fax.

Customer agrees to pay TriParish.net NSF charges of $25 for checks, and $10 for credit card denials.

It is the sole responsibility of the subscriber to track their own on-line connection time.

TriParish.net reserves the right to change its rates and/or services by notifying you 30 days in advance of the effective date of change.

Your service activation date will be listed as the first day of your monthly, quarterly, or yearly billing cycle, that TriParish is ready to provide service to your loaction, regardless of the actual date you begin receiving service, and shall not exceed ten days from the date you sign your contract, or the promised install date, whichever is later. Customers with a quarterly or yearly billing cycle will be invoiced one month prior to the end of their current billing cycle for all standard base service rates, and payment will be due not later than the first day of the next billing cycle. Customers with a monthly billing cycle will be invoiced and have their credit card of record charged before/on the first day of the next billing cycle for all standard base service rates.

If your payment instrument is returned unpaid for any reason, including but not limited to overlimit, expired, or otherwise not available to make payment, you will be notified of such by telephone and e-mail Checks and/or money orders that are returned by the bank for any reason will incur a $25 returned check fee. It is the sole responsibility of the customer to insure their payment instrument information is maintained current and available for payment of incurred fees.

TriParish.net reserves the right to suspend access to service for Customer’s Account(s) upon an indication of credit problems including delinquent payments. A reconnection charge equivalent to applicable activation fees will apply after payment of any outstanding balance for accounts over thirty (30) days past due.

If you default, you agree to pay TriParish.net its reasonable expenses, including attorney and collection-agency fees, incurred in enforcing its rights under these Terms and Conditions.

COST RECOVERY FEE

Effective October 2004, TriParish.net will begin charging a “BS” cost recovery fee of $2.97 per month for all broadband services. This fee is not a tax; it is intended to offset the cost of the Federal Universal Services Fund (FUSF) charge and other BellSouth (BS) compliance costs.

The FUSF was established by an Act of Congress in 1996. It helps to maintain affordable local telephone service for everyone and provides discounted phone service to schools, public libraries and rural health care providers. The FUSF also provides assistance to low-income and rural customers so they can maintain essential telephone service at a reasonable rate.

The 1996 Act states that all providers of telecommunications services should contribute to the FUSF. Broadband Internet service requires the purchase of wholesale components from Bellsouth Telecommunications, who has recently informed us that these components are subject to the Federal Universal Services Fund charge.

Please be aware that the new line item for the FUSF recovery fee will appear starting with October bills for broadband services. More information on the FUSF is available in detail from the FCC’s web site http://www.fcc.gov/wcb/universal_service.

OWNERSHIP/COPYRIGHT

Information available on TriParish.net network is the property of TriParish.net, its Information Providers, or other Customers. Customer shall not redistribute, reproduce, or commercially exploit such information without express written permission of its owner.

Information Providers shall have the right to assert and enforce such copyright provisions directly on their own behalf.

Customer submitting information owned by Customer for distribution on TriParish.net network grants TriParish.net non-exclusive permission to distribute the information product worldwide. Customers retain all rights Customer may have to such information and should expressly state such rights in conjunction with said information.

LIMITATION OF LIABILITY

ALL SERVICES ARE PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO THESE SERVICES OR ANY INFORMATION OR SOFTWARE PROVIDED THEREBY.

Neither TriParish.net nor its Information Providers are responsible for any damages arising from Customer’s use of TriParish.net network or inability to use TriParish.net network. There is no guarantee of message delivery. E-mail return receipts may be requested, but there is no guarantee that the recipient’s mail system will process or even acknowledge these requests.

TriParish.net is not responsible for Customer’s files residing on TriParish.net network. Customer is responsible for independent backup of all such data at a site determined by customer.

TriParish.net cannot and does not exercise any control whatsoever over the information passing through its network or through the Internet.

Due to the potential threat of viral attack, TriParish.net highly recommends the practice of safer computing to protect against computer viruses. TriParish.net is in no way responsible for any data loss or damage arising from viral infection from the Internet. Customers undertake browsing and downloading of Internet files at their own risk. Consult with your local computer reseller, systems analyst, consultant, and/or management information systems personnel to determine the anti-viral protection program best suited to your needs.

Customer is hereby warned that some Internet sites accessible via TriParish.net network allow posting, retrieval, and/or electronic mailing of materials that may be considered obscene or objectionable. TriParish.net not responsible for inadvertent or deliberate access to such material and cannot prevent access of such material. It is recommended that each customer closely monitors use of his/her account especially in the case of potential use or misuse by minor children. Accounts for minor children must be opened by a parent or legal guardian with their explicit consent.

TriParish.net network services may be used only for lawful purposes. Transmittal of any material in violation of any international, federal or state regulation is prohibited. This includes, but is not limited to: copyrighted materials, material legally judged to be threatening or obscene, or material protected by trade secret. You agree to indemnify and hold harmless TriParish.net (AKA Computer Sales & Services, Inc.) from any claims resulting from your use of the service which damages you or another party.

Any access to other networks through the TriParish.net network must comply with the rules appropriate for the other network. Violation of the rules of other networks is grounds for account cancellation. This includes, but is not limited to, mass Usenet posting, Usenet cross-posting, mass e-mailing, and/or the sending of unsolicited commercial e-mail.

TriParish.net and its affiliates shall not be liable under any legal theory (including tort or contract) for any direct, indirect, incidental, special or consequential damages in any way related to the product or services provided.

TriParish.net technicians are trained to deal with connectivity issues for our customers. TriParish.net is not responsible for any hardware conflicts or failures that may occur.

TriParish.net is not liable for any third party software, websites, or website contents.

OPERATION

TriParish.net reserves the right to change its services without notice including but not limited to access procedures, hours of operation, menu structures, commands, documentation, and services offered. Notice of modifications to these Terms and Conditions will be posted to this TriParish.net Network Web page. Customers are encouraged to review the current Terms and Conditions of Use on a regular basis. Customer’s use of TriParish.net network after such notice shall constitute Customer acceptance of such modifications.

Customer understands that TriParish.net network services may be interrupted for several reasons, including but not limited to malfunctions, maintenance, improvement or as required to protect network resources in the event of malfunctions or misuse. Customer understands that it may not receive advance notification of any such interruption of service. Scheduled outages will be sent via e-mail to all of our customers. TriParish.net shall not be liable for any delay in or failure to perform the services caused by circumstances entirely beyond its control such as those occasioned by acts of God or other causes or which it could not have reasonably foreseen or any other cause which similarly impedes the providing of service.

There will be no refunds for scheduled or unscheduled service interruptions of less than 24 hours duration. At its sole discretion, TriParish.net may elect to provide a pro rata or additional/extension of service refund for service interruptions of greater than 24 hours.

Customer hereby agrees that any material submitted for distribution on TriParish.net network through Customer’s Account(s) does not violate or infringe upon any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything obscene, objectionable, or libelous.

TriParish.net at its sole discretion and judgment may immediately suspend Customer’s access to the service upon any breach of any of the Terms and Conditions by Customer, including, but not limited to, refusal or failure to pay for services provided or disruptive on-line behavior.

TriParish.net reserves the right at its sole discretion to delete any information entered into TriParish.net network computer systems by Customer. TriParish.net and its authorized representatives shall retain the right, but shall not be obligated, to review/accept/reject publicly viewable information.

TriParish.net reserves the right to disconnect non-dedicated dial-up connections with inactivity for more than 15 minutes (“time-out”). Non-dedicated dialup and DSL connections may not be utilized as a dedicated connection, and TriParish.net reserves the right to disconnect or rotate IP addresses on non-dedicated dialup and DSL connections exceeding 5 hours in connection duration.

TriParish.net reserves the right to delete Customer’s personal files for which a storage fee has not been paid and which have not been accessed for more than one (1) month.

TriParish.net reserves the right to limit bandwith and /or network traffic of any entity for any reason at its sole discretion with or without notice.

TriParish.net reserves the right to terminate access to service for any Customer Account(s) which have been inactive for three (3) months or longer.

TriParish.net reserves the right to refuse and/or terminate service to anyone or any entity for any reason at its sole discretion with or without notice.

TriParish.net Web hosting customers are required to sign a Web hosting contract which delineates other terms and conditions.

Unlimited Access

Our goal is to provide our customers with the best residential Internet service possible. In order to help accomplish this, we have adopted this Fair Use Policy.

Unlimited access is not equivalent to unlimited usage of system resources.

To maintain the superior quality and performance of our networks and ensure the highest level of service performance for all users – which could be disrupted by the usage patterns of a small number of customers – we have established data usage thresholds under our Fair Use Policy. Under this policy, we has reviewed the monthly usage by service plan and established usage profiles under this Fair Use Policy that far exceed the average usage under each service plan. Usage that exceeds the monthly usage profiles will be considered a violation of this Fair Use Policy.

Activities that involve extensive high-volume and continuous data transfer might cause your activity to exceed the expected monthly amount. Examples of these activities may include (but are not limited to) extensive use of streaming video and peer-to-peer file sharing programs, or an unsecured wireless signal.

We proactively identify accounts with usage in excess of the plan profile. If your monthly usage exceeds the profile for your plan, we will provide the opportunity to upgrade your service plan or discuss how to maintain usage within the profile. We reserves the right to terminate service if a mutually agreed resolution cannot be reached.

We manage our networks with one goal: to deliver the best possible broadband Internet experience to all of its customers. High-speed bandwidth and network resources are not unlimited. Managing the network is essential as we work to promote the use and enjoyment of the Internet by all of its customers. The company uses reasonable network management practices that are consistent with industry standards. We try to use tools and technologies that are minimally intrusive and, in its independent judgment guided by industry experience, among the best in class. Of course, the company’s network management practices will change and evolve along with the uses of the Internet and the challenges and threats on the Internet.

The need to engage in network management is not limited to us. In fact, all Internet service providers manage their networks. Many of them use the same or similar tools that we do. If the company didn’t manage its network, its customers would be subject to the negative effects of spam, viruses, security attacks, network congestion, and other risks and degradations of service. By engaging in responsible network management including enforcement of this Policy, we can deliver the best possible broadband Internet experience to all of its customers.

TriParish.net reserves the sole right to charge for excessive usage. (Excessive usage is currently 10Gb per month for residential users and 25Gb per month for commercial users.)

At this time, TriParish.net does enforce a time usage limit on dial-up accounts of four continuous hours. This helps us manage dial-up resources usage and prevents monopolizing the system.

Disclaimer: Pricing and policies are subject to change without notice. TriParish.net will not assume responsibilities for damages resulting from using a system account in an irresponsible manner. We only provide Internet access services, carry a full uncensored news feed, and do not monitor for content. Minors must have signed parental consent. The parents or legal guardians of minors are solely responsible to police the user’s actions. All users are expected to voluntarily follow netiquette.

Resale of services and account sharing prohibited, unless prior consent is obtained from TriParish.net.

Open Internet Principles of Triparish.net and Cajun.net

The Federal Communications Commission issued rules to preserve the Internet as an open platform. These rules went into effect on November 20, 2011 and can be found at this link: http://www.gpo.gov/fdsys/pkg/FR-2011-09-23/html/2011-24259.htm. All Internet service providers are required to post information regarding various issues so that consumers, both residential and business, can make informed choices about choosing an Internet service provider. This document contains information regarding our services and in compliance with the FCC’s rules. The policies contained herein serve as a supplement to the existing terms of service.

The FCC’s rules focus on three primary issues:

Transparency. Fixed and mobile broadband providers must disclose the network management practices, performance characteristics, and terms and conditions of their broadband services;

No blocking. Fixed broadband providers may not block lawful content, applications, services, or non-harmful devices; mobile broadband providers may not block lawful Web sites, or block applications that compete with their voice or video telephony services; and

No unreasonable discrimination. Fixed broadband providers may not unreasonably discriminate in transmitting lawful network traffic.

Reasonable network management. ISPs may engage in reasonable network management to maintain a high quality of service for broadband Internet access.

Network Practices

ISPs must disclose their network practices, specifically in the four general areas listed below. ISPs may not block lawful content, applications, services, or non-harmful

devices, subject to reasonable network management. An ISP may not block consumers

from accessing lawful Web sites, subject to reasonable network management; nor shall the ISP block applications that compete with the provider’s voice or video telephony services, subject to reasonable network management. ISPs may not unreasonably discriminate in transmitting lawful network traffic over a consumer’s broadband Internet access service, although, reasonable network management shall not constitute

unreasonable discrimination. The FCC’s rules state that a network management practice is reasonable if it is appropriate and tailored to achieving a legitimate network management purpose, taking into account the particular network architecture and technology of the broadband Internet access service.

Congestion Management: We engage in constant monitoring of the network as a “whole”. This includes all services on the network. We aim to preserve the best Internet experience for all customers by preventing any subscriber(s) from monopolizing and/or negatively impacting the network and/or its subscribers. These practices are transparent. Please see http://www.triparish.net/termsandconditions.htm for more information.

Application-Specific Behavior:  We do not manage the network based on the application being used by a customer.

Device Attachment Rules: We do not restrict any devices to be used at the customer premise.

Security: We engage in industry standard activities to protect the network including active log monitoring and network infrastructure device monitoring for abnormalities and “known” threats.

Performance Characteristics

ISPs must disclose the following network performance characteristics:

Service Description: We provide broadband Internet access services via Asymmetric xDSL, Copper wireline, Terrestrial Fixed Wireless, Carrier Optical/Fiber to end user. Speed and latency depend on the service plan chosen. Real time applications such as VoIP may be used successfully on the network.

Impact of Specialized Services: We do not currently offer any specialized services.

Commercial Terms

ISPs must disclose the commercial terms of its broadband Internet access service including those listed below.

Pricing: Please contact us for available plans.

Privacy Policies: We follow industry standard policies to protect customers’ privacy. Traffic is only analyzed when service is impacted, abuse is suspected, when requested by a subscriber, or subject to a valid request from law enforcement authorities. Traffic information is not provided to third parties, or used by the ISP for non-network management purposes.

Redress Options: Customer complaints are handled on a case by case basis as needed. Customer satisfaction is always our goal.

FCC Notice

If a customer believes that these open Internet rules are not being met, the customer may file an informal complaint at the Federal Communications Commission. The FCC urges customers to submit any complaints via its website at the following address: http://esupport.fcc.gov/complaints.htm. Customers may also file a formal complaint at the FCC using Part 76 of the Commission’s rules.

DSL and Burglar Alarms: 

TriParish.net DOES NOT recommend installing DSL on the same phone line as your security system!

If you choose to install DSL on the same line as your security system, we recommend that you contact your alarm system provider for assurance that your security system is compatible with current DSL technology.

Many alarm systems may not function properly when sharing a phone line with a DSL connection, or the alarm system will prevent to proper operation of DSL Internet service.

TriParish.net or Computer Sales & Services, Inc. will not be held responsible for any disruption in your security service.

In the event that you decide to unsuccessfully attempt to install DSL on a phone line that is used by a security system, your setup and early termination fees in your contract will not be waived.

DSL and Changing Dial Tone Providers:

It is very important to notify TriParish.net of any changes that you are considering for the phone line that your DSL service is installed. This included, but is not limited to changes in dial tone provider, or phone line install address.

Any change to the phone line that DSL service is installed, may interrupt your service, and, may result in reconnect fees associated with the automatic termination of your DSL service, and reactivation in order to fulfill your agreement.

HOW we USE INFORMATION PROVIDED BY YOU: This site does not collect personally identifiable information about individuals except when specifically and knowingly provided by such individuals. A user’s personally identifiable information may be used by TriParish.net and its affiliates for editorial purposes. TriParish.net may also use such information for marketing and promotional purposes. We may share your personally identifiable information with other companies with which it conducts business. For example, if you enter our contests, make a purchase or use our e-mail services, we sometimes rely on outside companies to provide these services to you. In such cases, we need to provide your personally identifiable information to them. Or if you choose to purchase items through our commerce site, we will forward your information to third parties for credit card processing and order fulfillment. We also sometimes provide your information to our advertisers, so that they can serve ads to you that meet your needs. While TriParish.net will seek to require such third parties to follow appropriate privacy policies and will not authorize them to use this information except for the express purpose for which it was provided, TriParish.net does not bear any responsibility for any actions or policies of any third parties.

Except for purposes outlined above, we do not provide, sell or lease your personally identifiable information to any third parties, unless otherwise stated at the time of collection. If you have any questions or concerns regarding what is done with your information on any part of TriParish.net, please e-mail us at info@TriParish.net beforesubmitting any information.

We also collect anonymous, aggregated data and provide it to our advertisers and other companies that we do business with for market research and statistical purposes. For example, we might report to our advertisers that a certain percentage of users are between the ages of 30-35.

Finally, you should be aware that when you voluntarily disclose personally identifiable information (e.g., first and last name, address, e-mail address, etc) on the forums or in the chat areas, that information can be collected and used by others and may result in unsolicited messages from other posters or parties.

COOKIES: TriParish.net may place a “cookie” in the browser files of TriParish.net’s user’s computer. The cookie may contain personally identifiable information. Cookies enable TriParish.netto serve information that you have requested, or that relate to your use of TriParish.net to information that you have specifically and knowingly provided to TriParish.net. You also may occasionally get cookies from our advertisers. TriParish.net does not control these cookies and these cookies are not subject to this policy. The use of advertising cookies sent by third-party servers is common in the Internet industry. Most browsers are initially set to accept cookies. If you prefer, you can set your browser to refuse cookies or to alert you when cookies are being sent. However, it is possible that some portions of TriParish.net will not function properly if you do so. For further information on cookies and their use, see the help instructions delivered with your browser or contact the browser’s manufacturer. TriParish.net cannot provide help regarding your browser’s cookie settings.

CHILDREN: Be sure to ask your parents for permission before you send any information about yourself (your name, address, e-mail address, etc.) to us or anyone else over the Internet, and before making any purchases online. If you are under the age of 13, you are not allowed to use this service.

PARENTS: We encourage you to get involved with your children’s online usage and to be aware of the activities in which they are participating.
